What is a Refugee?

According to Canadian and international law, a refugee is someone forced to flee their country due to a well-founded fear of persecution based on race, religion, nationality, political opinion, or social group. Canada’s immigration system aligns with the United Nations 1951 Refugee Convention, granting protection to those who meet these criteria.

Refugee may be granted to individuals already in Canada who are unable or unwilling to return to their home country because of persecution on account of race, religion, nationality, membership in a social group (including sexual orientation), or political opinion. If you are granted refugee status, you will be allowed to live and work in the Canada. You will be able to apply for permanent residency one year after you are granted refugee status.

There is no minimum age for a child to submit a refugee claim in Canada. The United Nations Convention on the Rights of the Child (CRC) defines a child as “every human being below the age of eighteen years unless, under the law applicable to the child, majority is attained earlier.”
